1. Acceptance of Terms

Welcome to BengalTutors. These Terms & Conditions ("Terms") form a legally binding agreement between you ("you", "User") and BengalTutors ("BengalTutors", "we", "us", "our"), the operator of the website bengaltutors.com and any related mobile or web applications (the "Platform").

By creating an account, browsing, or using any feature of the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, you must stop using the Platform immediately.

2. Eligibility

You may use BengalTutors if:

• You are at least 18 years old, or
• You are a minor (under 18) using the Platform under the supervision and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

To register as a Tutor, you must be 18 or older and legally permitted to work in Bangladesh.

3. Account Registration

You must provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to:

• Notify us immediately of any unauthorised use of your account;
• Not share your account with anyone else;
• Use only one personal account (multiple or duplicate accounts may be terminated);
• Provide truthful information about your identity, qualifications, and location.

We may suspend or terminate accounts that contain false, misleading, or fraudulent information.

4. The Services We Provide

BengalTutors operates a marketplace that connects students and parents with independent tutors in two modes:

• Home Tutors — We introduce students to tutors who provide in-person lessons at the student's home or another agreed location. BengalTutors is not a party to the lesson itself; the tutoring service is provided directly by the tutor.
• Online Lessons — We host live online classes (1-to-1 and small group "mini batch" classes) through our virtual classroom, manage scheduling, and process payments on behalf of tutors.

BengalTutors does not employ tutors. Tutors are independent contractors who use the Platform to offer their services. We verify identity and academic credentials but we do not control how tutors teach.

5. Student & Parent Obligations

As a Student or Parent, you agree to:

• Pay the agreed lesson fees on time and through approved methods only;
• Treat tutors respectfully and provide a safe, appropriate environment for home lessons;
• Attend scheduled sessions or notify the tutor at least 4 hours in advance of cancellation;
• Not contact tutors outside the Platform for the purpose of bypassing fees or commissions;
• Provide accurate reviews and feedback;
• Comply with all applicable laws of Bangladesh.

For home tutoring with minors, we strongly recommend a parent or guardian be present during all sessions.

6. Tutor Obligations

As a Tutor, you agree to:

• Provide accurate, verifiable information about your qualifications, identity, and experience;
• Submit valid identification (NID or Passport) and academic certificates for verification;
• Conduct yourself professionally and ethically at all times;
• Maintain student confidentiality;
• Attend all scheduled sessions or notify both the student and BengalTutors at least 4 hours in advance of cancellation;
• Pay applicable commission within agreed deadlines (for home tutoring);
• Not solicit students to leave the Platform to avoid commission;
• Comply with all applicable laws of Bangladesh, including tax obligations on your earnings.

Tutors must never use physical discipline, share inappropriate content, or behave inappropriately with students. Violations result in immediate termination and may be reported to authorities.

7. Payments, Commission & Payouts

7.1 Payment processing

All online payments are processed through SSLCommerz, a payment gateway licensed by Bangladesh Bank. We accept bKash, Nagad, Rocket, Upay, Visa, Mastercard, AMEX, and direct bank transfer. BengalTutors does not store your card or wallet credentials.

7.2 Online lesson fees

Students pay the full lesson fee in advance via the Platform. BengalTutors deducts a 20% service commission from each session payment and remits the remaining 80% to the tutor's nominated bKash, Nagad, or bank account on a monthly basis (typically by the 5th of the following month).

7.3 Home tutoring fees

For home tutoring, the student pays the tutor directly after each lesson (cash, bKash, or otherwise). The tutor pays BengalTutors a 20% commission on the first month's earnings only from each new student. From month 2 onwards, the tutor keeps 100% and the lesson is no longer mediated by BengalTutors.

7.4 Taxes

Tutors are independent contractors and are solely responsible for declaring and paying any applicable income tax, VAT, or other levies on their earnings. BengalTutors does not deduct or remit tax on behalf of tutors.

7.5 Currency

All transactions are in Bangladeshi Taka (BDT) unless explicitly stated otherwise.

8. Cancellations & Refunds

Our complete refund policy is available at bengaltutors.com/refund and is incorporated into these Terms by reference. In summary:

• 100% refund if you cancel before your first online session;
• 100% refund for tutor no-shows;
• Pro-rata refund for unused sessions in a paid package;
• Refunds processed within 5–7 business days to the original payment method.

9. Acceptable Use

When using the Platform, you must not:

• Post false, misleading, defamatory, or fraudulent content;
• Harass, threaten, or discriminate against any other user;
• Share content that is illegal, obscene, hateful, or violates Bangladeshi law;
• Attempt to bypass platform fees by arranging payments outside BengalTutors;
• Use bots, scrapers, or automated tools without our written permission;
• Attempt to access, hack, or interfere with the Platform's systems;
• Impersonate any other person, including BengalTutors staff;
• Use the Platform for any commercial purpose other than tutoring services offered through us.

10. Intellectual Property

The Platform — including its logo, name, design, code, content, and database — is owned by BengalTutors and protected by Bangladeshi and international copyright, trademark, and other laws. You may use the Platform only as expressly permitted by these Terms.

Content you upload (tutor profiles, reviews, lesson materials) remains yours, but by uploading it you grant BengalTutors a non-exclusive, royalty-free, worldwide licence to use, display, and distribute it as part of operating and promoting the Platform.

11. Privacy

Your privacy is important to us. Please read our Privacy Policy to understand how we collect, use, and protect your personal information.

12. Disclaimers

BengalTutors is a marketplace and does not guarantee specific academic outcomes, exam results, or the quality of any individual lesson. The Platform and all services are provided "as is" and "as available", without warranties of any kind, express or implied.

We do not warrant that the Platform will be uninterrupted, error-free, or completely secure. We also do not endorse any specific tutor and are not responsible for disputes between users.

13. Limitation of Liability

To the maximum extent permitted by Bangladeshi law:

• BengalTutors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform;
• Our total cumulative liability to you for any claim shall not exceed the total amount you have paid to BengalTutors in the 6 months preceding the event giving rise to the claim, or BDT 5,000, whichever is greater;
• We are not liable for the conduct of tutors or students outside the Platform, including in-home interactions.

14. Indemnification

You agree to indemnify, defend, and hold harmless BengalTutors, its directors, employees, and agents from any claim, liability, loss, or expense (including reasonable legal fees) arising from: (i) your breach of these Terms; (ii) your misuse of the Platform; or (iii) your violation of any law or third-party right.

15. Termination

You may delete your account at any time from your account settings or by contacting us. We may suspend or terminate your account immediately, without notice, if you violate these Terms, fail to pay due amounts, or engage in fraudulent, abusive, or unlawful conduct.

On termination, your right to use the Platform ceases immediately, but provisions that by their nature should survive (e.g. payment obligations, intellectual property, limitation of liability) will continue to apply.

16. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be communicated by email or a notice on the Platform at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance of the revised Terms.

17. Disputes & Governing Law

These Terms are governed by and construed in accordance with the laws of Bangladesh. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts in Chattogram, Bangladesh.
